The Specifications of Electricity Connection is a list of requirements from the energy supply company that needs to be completed for the future consumer’s connection to the electronics network. Technical specifications (TS) are issued to determine the resource capabilities of both the customer and the electricity company.

Joining the network of the supplying electricity company is paid. The cost of connection depends on the degree of reliability and voltage at the point of connection.

List of required documents:

1) a copy of the document confirming the ownership or use of this object, or a copy of the extract from the State Register of real rights to immovable property, or, in the absence of the object, a copy of the document confirming the ownership or use of the land plot or a copy of the extract from the State register of real rights to real estate.

In the absence of the cadastral number in the certificate of ownership of a land plot it is needed the excavation from the topographical and geodetic plan or the plan of the development of the territory, indicating the location of the land;

2) a situational plan and a copy of the topographic-geodesic plan at a scale of 1:2000 indicating the location of the object (objects) of the Customer, the land plot of the Customer or the forecast point of connection (for objects that join the electrical networks for the first time);

3) a copy of the passport or duly executed power of attorney or other document for the right to concluding and signing the accession agreement;

4) Feasibility study (if available).

The customer – a legal entity or an individual entrepreneur additionally provides a copy of the extract from the Register of single tax payers or a copy of the certificate of the value added tax payer (hereinafter – VAT).

The Customer – the individual additionally provides the registration number of the taxpayer’s account card (for individuals who, because of their religious beliefs, refuse to accept the registration number of the tax card’s account and have informed the relevant authority thereof and have a passport in the passport provides the series and the passport number).

Step 5 Registration of the declaration or receipt of the beginning of construction work permit

Step 6 Development of project documentation for the construction of the facility

Project documentation is developed by specialized project organizations based on city-planning conditions and constraints, technical specifications and design tasks. Town-planning conditions and restrictions are issued by State Architectural and Construction Inspection for free of charge within 7 days from the date of receipt of the corresponding application. The technical specifications are issued by the authorities / institutions responsible for the engineering support of the construction site (water, heat, power, gas, sewage, outdoor lighting, etc.), usually within 15 days from the date of receipt of the corresponding application. The design task is made by the customer of the construction, in agreement with the designer. If the power plant qualifies as a construction site of 4-5 categories of complexity, then the design documentation is required to undergo an examination on compliance with the standards on sanitary and epidemiological welfare of the population, ecology, labor protection, energy saving, fire, technological, nuclear and radiation safety, durability, reliability, durability of buildings and structures, their operational safety and engineering provision.

Step 10 Obtaining a license for the production of electric energy

To obtain a “green” tariff, one of the following licenses is required: 1) a license for electricity production; 2) a license for the production of thermal and electric energy (cogeneration). Both of these licenses are issued by the National Energy Regulatory Commission. To obtain a license for electricity production, it is necessary to submit the following documents (in 5 sets, 1 of which notarized):

  • statement;
  • power of attorney (if the documents are submitted by the representative);
  • a document on the payment of a license fee;
  • copy of the statute (notarized);
  • description of the declared activity (technical characteristics of the object generating energy; the scheme of electrical connections with the indication of accounting devices);
  • a document confirming the Standard of Ownership Assets of Business Entities (a copy of the financial statements of F-№1 for the reporting period);
  • a copy of the document confirming the ownership of the generating capacity or the right to use them (with the confirmation of the ownership of a third person).

In case you plan to engage in cogeneration, before you apply for a license, you need to get permission to carry out work of high danger and operation (application) of machines, mechanisms, equipment of high danger.

The permit is issued by the State Service of Mining Supervision and Industrial Safety of Ukraine on the basis of the application and expert opinion on compliance with the requirements of the legislation on labor protection. The permit is free of charge and issued in 10 days from the date of receipt of the documents. However, drawing up an expert opinion necessary for obtaining a permit has a fee. The fee is determined depending on a variety of factors, in particular, the stated number of employees, types of work or mechanisms.

After obtaining the above permission, you can apply for a license for the production of heat and electric energy (cogeneration), for which it is necessary to submit the following documents (in 5 sets, 1 of which is notarized):

  • statement;
  • power of attorney (if the documents are submitted by the representative);
  • a document on the payment of a license fee;
  • copy of the statute (notarized);
  • a description of the declared activity (a list of cogeneration units, a description of the accounting system, a copy of the permit for high risk work and the operation (application) of machines, mechanisms, equipment of high danger);
  • a copy of the document confirming the ownership of the cogeneration units. The license for the production of electricity and the license for cogeneration are issued within 30 calendar days from the date of submission of documents.

Licensing is a paid procedure – when obtaining a license, you must pay a one-time fee of 18.87 UAH for 1 MW of installed capacity (for cogeneration units – an additional 21, 77 UAH per Gcal / hour of installed capacity). In addition, the licensee is required to pay the current value of the license, which is calculated by National Energy Regulatory Commission, depending on the installed capacity and the amount of supplied electricity and heat (for today it is up to UAH 1,000 per month for manufacturers).

Step 11 Registration of the status of an active member of the Wholesale Electricity Market

To obtain membership in the WEM, the following documents must be submitted to the WEM Board:

  • a statement;
  • power of attorney (in case of submission of documents by the representative);
  • A brief description of the applicant’s activities, indicating the territory in which the activity is scheduled for the first month, and in the future – under contracts for the supply of electricity;
  • data on the annual volumes of transactions that the applicant plans to carry out in the WEM;
  • information about the legal address and bank details of the applicant, certified by the signature of the first manager and the seal of the company (2 copies);
  • a protocol of agreement with the Administrator of the system of calculating volumes, forms, terms, methods of data transmission and procedures necessary for conducting calculations in accordance with the WEM Rules;
  • a statement on the nature of the expected transactions agreed with the settlement system administrator;
  • a certificate from NERC about the absence of arrears for payment of the current fee for a license;
  • Recommendation for admission from actual WEM members;
  • a notarized copy of the statute;
  • a notarized copy of the certificate of state registration of the applicant;
  • a copy of the certificate of registration of the VAT payer;
  • copy of the document appointing a manager;
  • Sample signatures of managers (responsible persons) who have the right to sign documents during the WEM activities.

There is a risk that you will be asked for additional documents not listed in the above list. The decision to admit to WEM is taken within 30 calendar days from the date of submission of documents and information.

After the decision has been made by the Council of the WEM, the applicant must sign the relevant contract within 28 calendar days.

Entry procedure for WEM members is free.

Step 12 Establishing a “green tariff”

To establish a “green” tariff, it is necessary to submit to the National Commission that carries out state regulation in the field of energy (NERC):

  • an explanatory note with detailed information on the subject of business (form of ownership of the enterprise; the installed capacity of the generating equipment; characteristics of the generating equipment);
  • calculation of the cost of production of electric energy using alternative energy sources (in the established form);
  • substantiation of the articles and elements of the production costs of electric energy (copies of contracts for the purchase of goods, works and services, estimates, decoding, reference on the average number of personnel, certificate on the book value of fixed assets, broken down by groups as of the date of application for approval of the “green”» Fare);
  • an explanatory note to the working project on the construction of power facilities;
  • a copy of the registered declaration on the commencement of construction work or the permit for construction work;
  • a copy of the technical conditions for connection to the power grids of power generation plants;
  • a registered declaration of readiness of the object for operation or a certificate of State Architectural and Construction Inspection;
  • a copy of the design and budget documentation for the construction;
  • a document (s) confirming compliance with the requirements of the Ukrainian component. The procedure for obtaining a decision on the “green” tariff is free of charge and will take no more than 45 calendar days from the date of submission of all documents and information.

Step 13 Establishment of an extra charge to the “green tariff” in case of use the equipment of the Ukrainian production at the facility

In order to get the “green” tariff, a certain part of the equipment (construction works) of the power plant should have a Ukrainian origin. Legislation establishes an exhaustive list of equipment (works) that can be counted as a Ukrainian component, with such lists approved for each source of energy (biomass, biogas, sun, and wind). The requirement for a Ukrainian component does not apply to hydroelectric plants. Ukrainian origin of materials and works is confirmed by certificates issued by the Chamber of Commerce and Industry of Ukraine or regional chambers of commerce and industry.

Step 14 Conclusion of a contract for sale and purchase of electric energy from SE “Energorynok” / Guaranteed buyer

The contract for the sale of electricity is concluded with SE “Energorynok”. A contract is required to submit an application. The applicant can expect 2 copies of the contract on the basis of a typical contract for the sale of electricity within 20-30 calendar days. After that, the agreement with the local power system of the NPC Ukrenergo may be necessary, and after that, the agreed and signed contracts will be transferred to the SE “Energorynok”. Signed by SE “Energorynok” copies of the contract can be expected within 20-30 calendar days. After signing the agreement, it must be submitted for approval to the NERC. The agreement of the NERC will take about 1-2 weeks. The procedure for concluding a contract does not involve any payment.
